How To Ensure The Will Is Valid?
When the Will has been located, you will need to ensure that the Will is valid before you can proceed or apply for probate.
A valid will must meet the following requirements:
- The Will must be in writing and have been made by a testator who is of sound mind, over the age of 18, and who was not under any duress when making the Will
- The Will must be dated
- The Will must be signed by the testator
- The testator’s signature must be witnessed by two independent witnesses, and each witness must sign the Will in front of the testator
